EXECUTIVE ORGANIZATION ACT OF 1965 (EXCERPT) Act 380 of 1965 16.134 Executive orders; filing; submission to legislature; publication; modification and repeal. Sec. 34. (1) Whenever the governor issues an executive order pertaining to organization of the executive branch, it shall be filed with the department of state in the same manner as required by law for the filing of public acts of this state. Copies of each such executive order shall be filed with and retained on record by the legislative council and a copy transmitted to each member of the legislature. (2) Whenever the governor makes changes in the organization of the executive branch or in the assignment of functions among its units which require the force of law, such changes shall be set forth in executive orders and copies of the orders shall be submitted to the legislature as provided in section 2 of article 5 of the state constitution. Unless disapproved in both houses by a resolution concurred in by a majority of the members elected to and serving in each house within the constitutional time period, such executive orders shall become effective at the date designated by the governor. (3) Executive orders as described in subsection (2) shall be dated, shall be given an identification number and published in the same manner as required by law for the publication of the public acts of the state. (4) An executive order as described in subsection (2) may be modified or repealed by the legislature at any time by law. History: Add. 1968, Act 237, Imd. Eff. June 26, 1968 Popular Name: Act 380
